Independent Contractor Agreement
This agreement, when signed by both parties, is an agreement between an independent contractor (Driver) and We Deliver Eats (WDE). Driver accepts the following requirements as the minimum acceptable conditions of agreement:
Driver understands that they are an Independent Contractor and are solely responsible to carry any license, permits, insurance, and/or any products needed to perform services for business.
Driver accepts full accident liability for personal injury and vehicular damage and for any traffic violations.
Driver will conduct him/herself in a professional manner when representing We Deliver Eats, including but not limited to restaurants, customers and clients.
Driver will obtain signatures for all deliveries when applicable. (Contact Free Delivery at this time must have visible proof of delivery to the correct address).
Driver will make all reasonable efforts to be prepared prior to starting their shift including but not limited to ensuring vehicle is adequately fueled, card and equipment are accessible for use.
Driver understands that they are expected to be ready to work (checking in via DriverLogic app) for their shift at the scheduled time they choose.
Driver is responsible to find a replacement Driver to take on their scheduled shift should the need to cancel arises within 48 hours. If the shift is not filled by another driver, you are expected to work it.
Drivers will use DriverLogic app to check in at their scheduled time, preferably 5-10 minutes early so that you may start at your scheduled time picking up at a restaurant.
Driver acknowledges a “three strikes” policy is in effect through the duration of this signed agreement and may result in termination of contractual employment at the discretion of WDE management. In addition, a “no call – no show” means no job and this is strictly enforced.
We Deliver Eats and Driver accept the following conditions of compensation and fees:
Drivers will use the “When I Work” mobile app to schedule shifts when available to deliver. Drivers may take as little or as many hours as they would like in any given week provided, they are available to work those shifts. Shifts are not required but will be given preferential deliveries as they contract you to work in specific times.
As part of your contract, you will keep itemized receipts from pickups for a term of one week. If receipts are not asked for within one week, you are free to dispose of them. If a driver receipt is asked for and the driver can not provide one, then depending on the order complication, the driver may be charged for items not completed.
Driver may keep cash paid by customer provided their payout for the day is equal to or more than the amount of cash accepted. If payouts are less than cash received, any remainder will be held from pay until the cash is paid back.
Driver shall be paid for each completed order. A completed order is defined as any order retrieved from restaurants and other businesses, ensuring the order is accurately filled, and complete delivery orders to consumers in a timely fashion.
Amount of payout for completed order may be adjusted due to missing or damaged item(s) if due to Driver error.
Forgotten items, if refunded will be charged to the driver. If a return delivery is required, the delivery fee will be charged to the driver.
All drivers are paid at least 70% of the delivery fee as a commission to start and 100% of tips that they have earned per delivery. (Delivery fees are based on distance and start at $1.95 and go up per mile.) WDE will report all payments made to the contractor on a calendar year basis using an appropriate IRS Form, if the volume of payments to the contractor qualify.
Your percentage can go up to 95% depending on completion rate and rating scale.
Driver agrees to maintain both a customer rating of a 4.2 or better and a completion rate of 85% or higher. Failure to satisfy this constitutes a breach in contract.
Equipment and products are available for purchase, should you not have what is needed to fulfill this position. Please let us know. These must be with you when doing deliveries.
WDE will process payments made by consumers and transmit to Driver their portion via direct deposit on no less than a weekly basis unless it notifies in writing. Payroll is submitted daily for all orders paid to WDE in full via credit card. If you have filled out the necessary information, you will start receiving payments within 48 hours of each day worked once you have completed 20 orders. Until that time, pay will be submitted on Wednesday following a Monday-Sunday work week for all orders. Portal orders pay out only once a week. Cash orders are paid directly to you. Should you wish to receive your pay on a slower schedule (i.e. weekly/monthly) after your initial setup please let us know. You will be paid in an amount consistent of Base Pay (time, distance, desirability) + Promotions (Peak Pay and/or challenges) + Tips (100% of the customer tips on top of Base Pay & Promotions) = Total Earnings (You will always earn base pay. Promotions and Tips vary by delivery.).
Some fulfillment orders placed directly with merchants rather than through the WDE app or website may be subject to a different pay model.
